Elevated Passover, Coastal Passover Retreats Corp., and their affiliates (“Elevated Passover”) act solely as agents in arranging the services offered. The carriers, hotels, and other service providers are independent contractors and are not agents, employees, servants, partners, or joint venturers of Elevated Passover or its affiliates. Airline schedules, equipment, and routings are subject to change by the airline or operator and will not result in any refunds. Flight delays and schedule changes are an inherent risk of air travel and are therefore beyond the control and responsibility of Elevated Passover. All certificates, tickets, and other travel documents issued by Elevated Passover are subject to the terms and conditions of the applicable suppliers and to the laws and regulations of the countries where the services are provided. Elevated Passover reserves the right to make changes to the itinerary or program services whenever deemed necessary for the comfort, convenience, or safety of participants, and to cancel a program at any time. Participants agree that neither Elevated Passover nor its affiliates shall be liable for any damage or loss, including but not limited to personal injury, death, property loss, delay, changes in air or program services, program cancellation, sickness, strike, virus, war, quarantine, weather, bankruptcy, disappointment, inconvenience, or expense arising from any act or omission of a supplier or service provider. If a program cannot operate for any reason, Elevated Passover and its affiliates shall not be responsible for refunds or reimbursements of travel, insurance, or related expenses.

Contract Terms & Conditions
  1. Third-Party Services. All services related to the Program that are not directly provided by Elevated Passover—including, without limitation, transportation, lodging, entertainment, and food and beverage—are supplied by independent third parties.
    Such services are provided without any warranties or representations of any kind, express or implied, by Elevated Passover.
  2. Force Majeure and Limitation of Liability. Elevated Passover shall have no responsibility or liability for any failure to provide services when prevented by causes beyond its reasonable control, including but not limited to strikes, labor disputes, accidents, fires, acts of government, acts of God, power outages, utility failures, pandemics, or mechanical breakdowns.

          Such events shall not constitute a breach of this Agreement. Elevated Passover does not assume liability for any personal property (“Property”)              brought to the Program by the Patron or any guest or invitee. All such property remains at the sole risk of the Patron.

  1. Patron Responsibility. The Patron shall be responsible for all liabilities, losses, claims, demands, damages, costs, and expenses—including, without limitation, property damage and/or personal injuries—suffered or incurred by the Hotel, its employees, or other guests arising directly or indirectly from the Patron’s attendance at the Program or use of Hotel services and facilities.
  2. Indemnification and Hold Harmless. The Patron agrees to indemnify, defend, and hold harmless Elevated Passover and its members, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, or costs (including reasonable attorneys’ fees) arising out of or connected with the Program or this Agreement, including claims resulting from the acts, omissions, or negligence of the Patron or any of the Patron’s guests, invitees, or agents.
  3. Entire Agreement and Non-Assignment. This Agreement constitutes the entire understanding between the parties and supersedes all prior or contemporaneous agreements, whether written or oral. It may not be modified or assigned by the Patron without the prior written consent of a corporate officer of Elevated Passover. No waiver, release, or alteration of any rights or provisions shall be valid unless made in writing and signed by a corporate officer of Elevated Passover.
  4. Governing Law and Arbitration. This Agreement and any dispute arising hereunder shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law principles. Any controversy, claim, or dispute arising out of or relating to this Agreement shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. Such arbitration shall be conducted in the County of Queens, State of New York, before a single arbitrator experienced in the hospitality, catering, or event-management industry. The written award of the arbitrator shall be final and binding and may be entered in any court of competent jurisdiction. All arbitration fees and reasonable attorneys’ fees shall be borne by the party against whom the award is rendered.
  5. Execution in Counterparts. This Agreement may be executed in counterparts, each of which shall constitute an original, and all of which together shall constitute one and the same instrument. Delivery of a signed copy by email or other electronic means shall be deemed valid and binding.
  6. No Waiver. The failure of either party to enforce any provision of this Agreement shall not be deemed a waiver of that provision or of the right to enforce it thereafter.
Cancellation Policy
  1. Deposits are refundable until October 20, 2025. After October 20, 2025 deposits are non-refundable. Final payment is due no later than January 26, 2026. There will be no refunds for any reason whatsoever for cancellations made after January 26, 2026 including for any missed days or missed meals during the Passover program. Please understand that the cancellation policy schedule and fees are neither arbitrary nor intended to be punitive. They are based on contractual obligations and on an evaluation of costs we incur.
  2. We strongly advise trip cancellation insurance to safeguard yourself against life’s uncertainties. We recommend Travel Defend. Alternatively, you can contact your regular insurance agent and ask them if they can recommend a travel cancellation insurance company.
